These terms and conditions outline the rules and regulations for the use of GiblTCG's Website and API services.

By accessing this website we assume you accept these terms and conditions in full. Do not continue to use GiblTCG if you do not accept all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", "You" and "Your" refers to you, the person accessing this website and accepting the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in accordance with and subject to, prevailing law of Canada.

1. Intellectual Property & Affiliation Disclaimer

GiblTCG is an unofficial, community-driven, third-party database and API resource. We are not affiliated with, sponsored, endorsed, or approved by any of the companies, publishers, sports leagues, or licensing agencies that own the respective trading cards, sports cards, or collectible card games featured on our platform.

All character names, player likenesses, team logos, card text, images, set icons, and other related intellectual property are trademarks and copyrights of their respective owners, publishers, and licensors, including but not limited to:

  • Yu-Gi-Oh!: © Konami Digital Entertainment and Studio Dice/Shueisha, TV Tokyo, NAS.

General Collectibles Clause: Any and all other trading card games, sports cards, non-sports cards, and collectible cards not explicitly listed above remain the exclusive property, trademark, and copyright of their respective creators, publishers, and associated sports leagues (including but not limited to the NBA, NFL, MLB, NHL, FIFA, UEFA, and their respective players' associations).

The use of any such materials through our API, image identification services, and website is strictly for informational, educational, and database indexing purposes under the legally recognized principles of "Fair Use." We do not claim ownership, nor do we claim to hold any licenses, to any of the aforementioned third-party intellectual property. If you are a rights holder and believe your content is being used in a way that constitutes copyright infringement outside the bounds of Fair Use, please contact us immediately.

2. License and API Usage

The proprietary code, database structures, APIs, design, graphics, and original text provided by our platform (collectively, our "Content") are owned by or licensed to GiblTCG, and are protected under applicable laws. Except where explicitly stated, we retain all rights to our Services and Content.

You are granted a limited, nonexclusive, nontransferable, non-sublicensable, revocable license to access and use our Services and API. However, this license does not permit you to:

  1. Sell, resell, rent, or lease our Services, API keys, or Content commercially;
  2. Bypass, circumvent, or attempt to disable any rate limits, security features, or access controls implemented on our API;
  3. Employ any data mining, robots, mass scraping, or similar data collection extraction tools outside of standard API usage limits;
  4. Use our image identification services or API data to build a directly competing database product without prior written consent.

Any unauthorized use or abuse of our API infrastructure will result in the immediate termination of the license provided in this Agreement, including the revoking of API keys.

3. Payments and Subscriptions

All subscription payments, including API access tiers, are non-refundable. This means that once you subscribe and your payment is processed, there will be no refunds or credits for partial subscription periods or for periods in which your account remains open but you do not use the services.

Unless otherwise stated, subscriptions will automatically renew for the same subscription period at the end of each billing cycle. You may cancel the automatic renewal at any time, but no refunds will be issued for any remaining portion of the subscription period.

You have the right to cancel your subscription at any time. However, cancellation will only become effective at the end of your current billing cycle.

GiblTCG reserves the right to change the subscription fees, API rate limits, or these terms at any time. Changes will be effective immediately upon posting to the website and will apply to all subsequent subscription periods.

4. Hyperlinking to our Content

The following organizations may link to our Web site without prior written approval:

  • Government agencies;
  • Search engines;
  • News organizations;
  • Online directory distributors.

These organizations may link to our home page, to publications or to other Web site information so long as the link: (a) is not in any way misleading; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and (c) fits within the context of the linking party's site.

We may consider and approve in our sole discretion other link requests. If you are interested in linking to our website, you must notify us by sending an e-mail to info@gibltcg.com. No use of GiblTCG's logo or other artwork will be allowed for linking absent a trademark license agreement.

5. Iframes

Without prior approval and express written permission, you may not create frames around our Web pages or use other techniques that alter in any way the visual presentation or appearance of our Web site.

6. Content Liability

We shall have no responsibility or liability for any content appearing on your Web site or Application that utilizes our API. You agree to indemnify and defend us against all claims arising out of or based upon your Website. No link(s) or API integrations may appear on any page on your Web site or within any context containing content or materials that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

7. Reservation of Rights

We reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to our Web site. You agree to immediately remove all links to our Web site upon such request. We also reserve the right to amend these terms and conditions at any time.

8. Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website, our API services, and the use of this website. Nothing in this disclaimer will limit or exclude our or your liability for death or personal injury resulting from negligence, or limit or exclude liability for fraud.

The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort, and for breach of statutory duty. We do not guarantee that image identification results or data returned by the API will be 100% accurate at all times.

To the extent that the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.
